Opinion of an Advocate

In November 2018 I employed an advocate to give an opinion on the claim I was bringing in the Employment Tribunal. The advocate formed her opinion on the evidence I provided her with. She objectively read the evidence, the same evidence that was submitted to the Tribunal, and concluded that regardless of what the employer was stating, there was a transfer of functions and duties.

The evidence for this was contained in an email that my line-manager, Mr Lewis, sent to Mrs Byrne’s line-manager, Mrs Smith. In the email Mr Lewis asked Mrs Smith how she got on with changing Mrs Byrne’s position to be in charge of digitisation. The email is clear that Mr Lewis wanted duties currently being undertaken by me to be undertaken by Mrs Byrne and that of necessity would involve a transfer of functions and duties.
